Since I am navigating the confusing employment laws world…I decide that it would be interesting to share some of my findings with you. At least things I did not know…in regards to employment laws.
Did you know that, according to the Employee Polygraph Protection Act, “The law does not cover federal, state or local government agencies.” I did not know that, and I think its pretty good information to know.
Did you know that the Fourth Amendment of the United States Constitution protects against unreasonable search and seizure. Furthermore, the Supreme Court has consistently held that drug testing constitutes a search…pretty good info too. Now, keep in mind that private employers as well as government agencies did find a way around the drug testing. The can actually drug test, but they most follow some requirements. So, when in doubt, READ…find the law and learn about it.
Have you heard about the Omnibus Transportation Employees Testing Act? I just recently learned about it, again super interesting and must-have act. It pretty much mandates excessive drug and alcohol testing, but only for employees in industries regulated by the Department of Transportation.
Needless to say that learning about employment laws is very complicated, and difficult to understand, tons of research must be done, to make sure that no employment laws are violated.
I just keep on learning, keep on learning…pretty interesting stuff that affects all in one way or another.
